User Agreement

HeartX ("HeartX" or "we" or "us" or "our") provides the basic terms and conditions for you ("Artist" or "you" or "your") to display or sell artwork or other published content (each, an "Item") in HeartX through HeartX products and services, including any HeartX mobile applications (collectively, the "Services"). Once you have registered and posted content to the HeartX Community Artists on this page, the content you post will become part of the HeartX Community and you will be deemed to have agreed to and abided by the following Cooperation Agreement.
You must comply with the following agreement and your representations and warranties, and you shall be solely responsible for any adverse consequences or liability arising from your breach of any of them or related laws and regulations.
HeartX protects original works
HeartX encourages and protects original works of art, such as paintings, sculptures, photography, and other artwork, or published content such as articles, videos, images, songs, books, music, etc. Copyright laws around the world are designed to protect original works of authorship, and to be eligible for copyright protection, a work must be created by the author and have some degree of innovation. HeartX is committed to copyright protection of original works and content, so if you are the author of an original work and find a work on HeartX that you created but was not uploaded by you or an appointed agent, please contact us and we will assist in the verification and processing.

- To publish original content that is free from copyright disputes.
- Respect the copyright, privacy and reputation of others.
- To be tolerant and rational towards different artistic styles, artistic perspectives, aesthetic tendencies and academic opinions.
- Share freely with other community members, explore openly, and communicate civilly.
Artist and Creator Onboarding Agreement
HeartX ("HeartX" or "we" or "our") provides you ("Artist" or "Creator" or "you" or "your") with the basic terms and conditions for collaboration when displaying or selling creative works or other published content ("Content") through HeartX products and services, including any HeartX web version and mobile applications (collectively referred to as the "Service"). Once you register as a HeartX Artist or Creator on this page and publish content, your published content becomes part of the HeartX community, and we will consider that you have agreed to and complied with the following collaboration agreement. Please be sure to follow this agreement and your representations and warranties. If you violate any of the terms or any related laws and regulations, you will be solely responsible for any adverse consequences or legal liabilities arising therefrom.
HeartX Protects Original Works
HeartX encourages and protects original works, such as paintings, videos, animations, photographs, and 3D digital models, as well as articles, videos, images, songs, and music, and other published content. Copyright laws worldwide aim to protect the original works of creators. To be eligible for copyright protection, a work must be created by the creator and possess a certain degree of originality. HeartX is committed to protecting the copyrights of original works and content. If you are the creator of an original work and find your creation on HeartX but not uploaded by you or your designated agency, please contact us, and we will assist in verification and handling.
In the spirit of honesty and fairness, for the prosperity of the HeartX art community, please abide by the following guidelines within the HeartX community:
- Publish original content that does not involve copyright disputes.
- Respect the copyrights, privacy, and reputation of others.
- Tolerate and rationalize different artistic styles, viewpoints, aesthetic preferences, and academic opinions.
- Engage in free sharing, open discussions, and civilized communication with other community members.

| If you post any of the above content, it will be immediately deleted, whether it is reported and complained by other users and artists or if the platform's content review committee deems it to be in violation of the rules. Your relevant account or IP address will be banned; for serious violations, HeartX reserves the right to submit to judicial authorities for handling. If any losses are incurred to the HeartX platform or other community users, HeartX reserves the right to pursue accountability. | |
Representations and Warranties of Artists and Creators
You represent and warrant that
- you are the sole owner of each work (published content) or have obtained formal authorization from the owner of each work (published content) to provide and sell such works;
- you have the right to provide and sell each work under this agreement;
- the good, valid, and marketable ownership and possession of each work will be transferred to the buyer upon sale, without any claims, restrictions, liens, or other property burdens from any third party, including but not limited to government or government claim agencies and any resale contract restrictions;
- each work is authentic and not forged;
- you have provided and will continue to provide HeartX with all information about the work you own during online sales, including authenticity, origin, modifications, and conditions, and you guarantee that such information is accurate and authorize HeartX to share such information with potential buyers upon their request;
- if applicable, each item has been legally imported into its current jurisdiction and legally exported under the laws of its previous country/region, and any taxes and/or duties related to such import and export have been paid;
- any and all data provided for describing the work is accurate;
- unless expressly stated otherwise, you will collect, pay, report, and remit any and all seller taxes and any other taxes and duties required by applicable laws related to the listing, marketing, quoting, or sale of each work.
